    I'd get the builder back to straighten the house up.
    Use the biggest hammer you like, pounding a square peg into a round hole does not equal a proper fit.

    I'd get an extension for the downspout and have it go away from the unit.

    Reminds of a job years ago, ( McMansion House ) the owner of the residence had us move one unit of three placed in a row, because it was a eye sore when they looked out that window. The unit was not anywhere as tall as that one.

    Put the spout right against the coil and you have an automatic condenser cleaning

    All you need is a scrap chunk of 2x4, cut to the right size, and jammed between the house and the top of the unit. Tell the customer the 2x4 is free of charge, but you still need to collect the truck charge and 1 hour of labor. Then smile, tell them to have a nice day, and get the F out of there.

    Most leaning like the one pictured

    5 to the other side of the window and would have been better. But think all that extra copper it would have needed.
