    Durham investigation into origins of 2016 Trump campaign surveillance expands its scope

    EXCLUSIVE – John Durham, the U.S. attorney reviewing the origins of the 2016 counterintelligence investigation into Russia and the Trump campaign, is probing a wider timeline than previously known, according to multiple senior administration officials.

    Fox News previously reported that Durham would be reviewing the days leading up to the 2016 election and through the inauguration.

    However, based on what he has been finding, Durham has expanded his investigation adding agents and resources, the senior administration officials said. The timeline has grown from the beginning of the probe through the election and now has included a post-election timeline through the spring of 2017, up to when Robert Mueller was named special counsel.

    Just when you think Bill Barr and John Durham aren’t going to deliver anything worthwhile, we go and get leaks like this that re-peak my interest.

    As we’ve known for most of the year now, the DOJ is currently conducting a probe of the origins of the Trump-Russia investigation. This includes possible corruption in the FISA process, as well as the improper surveillance of Trump and his campaign. Except now it appears they aren’t just looking into the origins anymore. A new report is saying that the investigation has expanded to cover post the inauguration.

    WASHINGTON — A review launched by Attorney General William Barr into the origins of the Russia investigation has expanded significantly amid concerns about whether the probe has any legal or factual basis, multiple current and former officials told NBC News.

    The prosecutor conducting the review, Connecticut U.S. Attorney John Durham, has expressed his intent to interview a number of current and former intelligence officials involved in examining Russia's effort to interfere in the 2016 presidential election, including former CIA Director John Brennan and former director of national intelligence James Clapper, Brennan told NBC News.

    NBC News reported that Attorney General William Barr and Prosecutor John Durham have expanded their examination of the origins of the Trump/Russia investigation. Durham has increased the size of his staff and has pushed out his timeframe.

    Durham will be interviewing former CIA Director John Brennan and former Director of National Intelligence James Clapper along with other current and former intelligence community officials. According to NBC:

    Durham has also requested to talk to CIA analysts involved in the intelligence assessment of Russia’s activities, prompting some of them to hire lawyers, according to three former CIA officials familiar with the matter. And there is tension between the CIA and the Justice Department over what classified documents Durham can examine, two people familiar with the matter said.

    With Barr’s approval, Durham has expanded his staff and the timeframe under scrutiny, according to a law enforcement official directly familiar with the matter. And he is now looking into conduct past Donald Trump’s inauguration in January 2017, a Trump administration official said.

    Although the probe did not begin as a criminal investigation, Justice Department officials won’t comment on whether it has morphed into one.

    John Brennan told NBC that Durham’s investigation is “bizarre” and said, “I don’t know what the legal basis for this is.” He doesn’t? Let me refresh his memory.

    Brennan’s obsessive fear that Donald Trump might win the presidency may have instigated the whole collusion narrative. He didn’t have to twist many arms to bring others on board, but his exhaustive search for “dirt” on Trump and his insistence that the FBI open a counterintelligence investigation was key.

    I’ll never forget writer George Neumayr’s (The American Spectator) description of Brennan’s CIA. He wrote it April 2018, but it was so spot on, I remember it today. He wrote, “John Brennan’s CIA operated like a branch office of the Hillary campaign.” Neumayr called the Trump/Russia investigation “the probe from nowhere to nowhere, undertaken simply to satisfy the partisan hunches of John Brennan and other Trump haters in the Obama administration.”

    Neumayr wrote that, based upon Brennan’s testimony and his leaks, he started pushing the FBI to open an investigation in the spring of 2016. He would present the FBI with what he called evidence....

    Yesterday, RedState via Elizabeth Vaughn shared the news that Durham had further expanded his investigation to include James Clapper and John Brennan. This, of course, left Brennan flailing about wildly, wondering why the DOJ would even be interested in him.

    WASHINGTON — For more than two years, President Trump has repeatedly attacked the Russia investigation, portraying it as a hoax and illegal even months after the special counsel closed it. Now, Mr. Trump’s own Justice Department has opened a criminal investigation into how it all began.

    Justice Department officials have shifted an administrative review of the Russia investigation closely overseen by Attorney General William P. Barr to a criminal inquiry, according to two people familiar with the matter. The move gives the prosecutor running it, John H. Durham, the power to subpoena for witness testimony and documents, to impanel a grand jury and to file criminal charges

    You can just imagine the spittle flying as they typed this. They really, really don’t want this to be looked into and by shifting it to a criminal investigation, the DOJ now has full power to compel witness testimony. That’s bad news for a lot of people who have been flailing about, insisting there’s no reason they should be investigated.

    Of course, instead of just sticking to the facts, the unbiased reporters at the Times described the shift in this manner.

    The opening of a criminal investigation is likely to raise alarms that Mr. Trump is using the Justice Department to go after his perceived enemies.

    Yes, that’s the problem here. Not that the DOJ has enough evidence to start criminally investigating people, but that it’s happening at all and some might be “alarmed.” Isn’t it weird how they had none of these reservations with the Obama administrations investigation into Trump, nor the Mueller investigation.

    Durham's investigation into possible FBI misconduct is now criminal probe, sources say

    U.S. Attorney John Durham's ongoing probe into potential FBI and Justice Department misconduct in the run-up to the 2016 election through the spring of 2017 has transitioned into a full-fledged criminal investigation, two sources familiar with the investigation told Fox News on Thursday night.

    One source added that DOJ Inspector General Michael Horowitz's upcoming report on alleged FBI surveillance abuses against the Trump campaign will shed light on why Durham's probe has become a criminal inquiry. Horowitz announced on Thursday his report would be available to the public soon, with "few" redactions.

    The investigation's new status means Durham can subpoena witnesses, file charges, and impanel fact-finding grand juries.

    Merry Christmas. The intercept is reporting that former NSA Director, Admiral Mike Rogers, has been working with U.S. Attorney John Durham for several months during his investigation into the origin of the 2016 intelligence operation against candidate Trump.

    This is particularly important because NSA Director Mike Rogers’ knowledge is at the epicenter of the origination of almost everything related to the FBI data-surveillance that was happening in 2015 and 2016.

Michael Rogers, former director of the National Security Agency, has been cooperating with the Justice Department’s probe into the origins of the counterintelligence investigation of the Trump presidential campaign’s alleged ties to Russia, according to four people familiar with Rogers’s participation.

    Rogers has met the prosecutor leading the probe, Connecticut U.S. Attorney John Durham, on multiple occasions, according to two people familiar with Rogers’s cooperation.

    While the substance of those meetings is not clear, Rogers has cooperated voluntarily, several people with knowledge of the matter said.

    Rogers, who retired in May 2018, did not respond to requests for comment.

    BACKSTORY: When Intelligence Chairman Devin Nunes explained his concerns in March 2017 -about what he saw from a review of 2016 intelligence gathering, reporting and subsequent unmasking- the issue behind his concern was clouded in mystery. Indeed the larger headlines at the time were about demanding a special prosecutor and driving the Russia conspiracy narrative.

    1.) …”On numerous occasions the [Obama] intelligence community incidentally collected information about U.S. citizens involved in the Trump transition.”

    2.) “Details about U.S. persons associated with the incoming administration; details with little or no apparent foreign intelligence value were widely disseminated in intelligence community reporting.”

    3.) “Third, I have confirmed that additional names of Trump transition members were unmasked.”

    4.) “Fourth and finally, I want to be clear; none of this surveillance was related to Russia, or the investigation of Russian activities.

    “The House Intelligence Committee will thoroughly investigate surveillance and its subsequent dissemination, to determine a few things here that I want to read off:”

    •“Who was aware of it?”

    •“Why it was not disclosed to congress?”

    •“Who requested and authorized the additional unmasking?”

    •“Whether anyone directed the intelligence community to focus on Trump associates?”

    Immediately after Nunes expressed those concerns during a press conference the media went bananas and Nunes became target #1.

    In hindsight, and with information from our assembled timelines of 2016 though today, we can now revisit those March 2017 concerns expressed by Chairman Nunes with a great deal more perspective and information.     Admiral Mike Rogers became NSA director in April 2014.

    Sometime in early 2016 Admiral Rogers became aware of “ongoing” and “intentional” violations of Foreign Intelligence Surveillance Act (FISA), Section 702(17) surveillance. Specifically item #17 which includes the unauthorized upstream data collection of U.S. individuals within NSA surveillance through the use of “About Query”.

    Section 702 – Item #17 “About Queries” are specifically the collection of electronic messaging, emails and upstream phone call surveillance data of U.S. persons.

    The public doesn’t discover this issue, and Director Rogers action, until May 2017 when we learn that Rogers told the FISA court he became aware of unlawful surveillance and collection of U.S. persons.

    Put into context, with the full back-story, it appears that 2016 surveillance was the political surveillance, the stuff Chairman Nunes was questioning. The dates here are important as they tell a story.

    As a result of Rogers suspecting FISA 702(17) surveillance activity was being used for reasons he deemed unlawful, in mid 2016 Rogers ordered the NSA compliance officer to run a full audit on 702 NSA compliance.

    Here’s the part where we find criminal intent and malice aforethought.

    By looking at the way the FISA court was notified, it becomes apparent the DOJ National Security Division set Admiral Mike Rogers up to take the fall for their unlawful conduct.

    Asst. Attorney General in charge of the DOJ National Security Division, John P Carlin, preempted Rogers by filing a notification with the FISA Court on 26th September 2016 (look at the pdf). DOJ-NSD head John Carlin was setting up Rogers as the scapegoat while knowing the NSA FISA compliance officer was still reviewing their conduct.

    BACKGROUND – With research files on the ’15, ’16 and ’17 political surveillance program; including information from the Mueller report and information from the IG Horowitz report; in combination with the Obama-era DOJ “secret research project” (their words, not mine); we are able to overlay the Obama-era domestic IC operations and gain a full understanding of how political surveillance was conducted over a period of approximately four to six years.

    Working with a timeline, but also referencing origination material in 2015/2016 – CTH hopes to show how the program(s) interacted and operated. A full review explains an evolution from The IRS Files in 2010 to the FISA Files in 2016.

    More importantly, the assembly of government reports and public records now indicates a political exploitation of the NSA database, for weaponized intelligence surveillance of politicians, began mid 2012.

    The FISA-702 database extraction process, and utilization of the protections within the smaller intelligence community, became the primary process. We start by reviewing the established record from the 99-page FISC opinion rendered by Presiding Judge Rosemary Collyer on April 26th, 2017; and explain the details within the FISC opinion.

    I would strongly urge everyone to read the FISC report (full pdf below) because Judge Collyer outlines how the DOJ, which includes the FBI, had an “institutional lack of candor” in responses to the FISA court. In essence, the Obama administration was continually lying to the court about their activity, and the rate of fourth amendment violations for illegal searches and seizures of U.S. persons’ private information for multiple years.

    Unfortunately, due to intelligence terminology Judge Collyer’s brief and ruling is not an easy read for anyone unfamiliar with the FISA processes outlined. The complexity also helps the media avoid discussing, and as a result most Americans have no idea the scale and scope of the issues. So we’ll try to break down the language.

    For the sake of brevity and common understanding CTH will highlight the most pertinent segments showing just how systemic and troublesome the unlawful electronic surveillance was.

    Early in 2016 NSA Director Admiral Mike Rogers was alerted of a significant uptick in FISA-702(17) “About” queries using the FBI/NSA database that holds all metadata records on every form of electronic communication.

    The NSA compliance officer alerted Admiral Mike Rogers who then initiated a full compliance audit on/around March 9th, 2016, for the period of November 1st, 2015, through May 1st, 2016.

    While the audit was ongoing, due to the severity of the results that were identified, Admiral Mike Rogers stopped anyone from using the 702(17) “about query” option, and went to the extraordinary step of blocking all FBI contractor access to the database on April 18, 2016 (keep these dates in mind).

    Here are some significant segments:

    The key takeaway from these first paragraphs is how the search query results were exported from the NSA database to users who were not authorized to see the material. The FBI contractors were conducting searches and then removing, or ‘exporting’, the results. Later on, the FBI said all of the exported material was deleted.
