Color code for the wires is wrong also. That is 240 color code. It kind of looks like a 240 volt disconnect too.

If you look very closely all 3 on bottom have the same brown ring at the top.

I would have the ground properly connected or refuse to work on it.

Unless something changed recently, the NEC doesn't require specific colors for 460 v 208/220. The B-O-Y is common for 460, but I don't believe there's a hard rule on phase colors WRT to voltage delivered, other than that the high leg be marked with orange.

Had a neutral on a job the other day that would spark a little bit every time you touched it to ground

I can beat that without breaking a sweat.
5 ton York rooftop 220V single phase unit with a 20 kw electric duct heater.
    Commercial building management company.
My first call to this location.
The Teck cable comes from the disconnect switch mounted to the unit.
The Teck cable only supplies the duct heater.
The compressor and supply air blower are supplied by the 6/2 NMWU which has no disconnect and no markings.
I did not know this at the time.

I was called for a loud noise coming from the unit.
I turned off the disconnect and tested the 3 legs with my meter which naturally showed no voltage.
I opened the panel and touched the motor which was hot to the touch.
I was about to turn the pulley to see if the bearings were done when the thermal overload protection on the motor closed and the motor started spinning.
Someone was looking out for me that day.

As you can see the unit is getting a grease shower from the kitchen exhaust.
