Some ironies here with Scalia and what the repubs are doing. Scalia was an Originalist, New Originalist and sometimes referred to as an Original Intent interpreter of the Constitution. Now forget for the meantime that either of those are nonsensical if one studies history and the framers. But with the repubs refusing to even give a hearing with almost a year left is unprecedented. Heck there weren't even public hearings until 1916. And that was probably because Brandeis was Jewish. The first to serve on the court. If you were an Originalist or believed in Original Intent it seems you would just do what was done when the framers were alive and that was just to give a vote. Nominations and votes sometimes only took days. But when hypocrites are in power of the senate this is to be expected.

First if you call yourself an originalist or an original intent Constitutional believer you would be a hypocrite.

Second I believe that in a case like this with a dem pres and a repub senate(or visa versa) that a moderate should be nominated and approved by the senate. That was just what Schumer and Biden said if you read their full statements you are referring to.

Now I disagree when they were talking about hypothetically not hearing a nomination. But they did correct themselves in their statements. And there is a difference between the hypothetical and it really happening. Their statements are nothing like the republicans are saying.

I have no idea what you are talking about with Obama or NPR. But Dixiecrats were conservative democrats from the south or a conservative group that broke off in 1948 for their own party. You may want to try to redefine the term conservative but it is already defined.

Obama could make a recess appointment and that appointment would stay in until the next presidents appointment is confirmed. And he could nominate anybody he wants then. Or another scenario is when the dems take the senate back this fall the senators are confirmed on 1-3-2017. Obama stays in office till 1-20-2017 then they could push through anybody they want. The last scenario would be even if Trump wins. Of course wouldn't be necessary if Hilary wins.

So this could backfire on you guys.

A little sidenote. Thomas the other or remaining Originalist hasn't asked a question in court for 10 years. I wonder if this is why Scalia asked for Obama to appoint someone smart to the court like Kagan. This was before she was nominated.
