Compared to a TXV, EEV can/will open further initially, requiring more LL volume as it's controlling and maintaining say 8°SH on a high load...

Very likely that equipment is not rated for 40°f return air temperature. Typically I'd say 55 should be the very lowest, and 60 is much safer.
