No California does NOY say a tenant is required to have air conditioning. It says they must have screens, if the apartment came with AC and it is broke down and the landlord has no money to fix it, you move!
It might be different in a Rent Controlled area but we don't live where there is Rent Control... HAving been a lanlord for over 20 years In know the law to well... Been there done that..
I wouldn't expect the owners to do a lot more . You now have a matched system . Time to ask for a downstairs apartment or get out of your lease. I'm not an attorney, but I don't think there are any laws that you have to have A/C,heat possibly, not A/C.Are you the only tennant having this problem?
before spending the money to move why not call out an hvac company to look at it. whith the low temp split you mention I would suspect that it is a simple problem that only a good tech can find. just be upfront with them about what you need them for.
And if I hire my own competant tech and it does prove that something is wrong or it's undersized, I'm positive that the Landlord will have a different outlook on this and start getting snappier with the techie that installed the system. Because after all the landlord is the one footing the bill once all these A/C's die from nonstop use.
But can I make the landlord pay for the bill? If I'm right of course.
