Out of control big brother government
i was doing some legal research and i found out some shocking information.
according to this attorney's website i was reading , it is now common practice for employers to be given access to arrest records. (NCIC database)
...let alone if you have never been convicted, the webite says that even if they never bring charges against you, the information will be viewed by potential employers.
this is absolutley disgusting, what this means is if you are arrested for any reason, you are basically convicted of that crime.
a lot of people in America have fantasies about employers reviewing your case and making a judgement, that's not the way it works.
company policy works on red-light green-light, if ANYTHING pops up, your application is in the trash, people could care less about how you were not guilty .
PEOPLE ARE TOO IMMATURE TO HANDLE THIS KIND OF INFORMATION.
our country was never created this way and never had any kind of policies like this until they formed the FBI.
early American courts would have found this unconstitutional.
if you think this means America is getting tough on crime, think again.
our government has accepted criminals from around the world and has allowed illegal immigrants to use false identification and fake Social Security numbers.
the SS office simply tries to file all their fake numbers.
the government has ordered police departments not to arrest these people of unknown backgrounds when they get caught with fake ID.
illegals who commit crimes simply re-appear with a new ID
NOTHING GOOD WILL COME FROM CORRUPT GOVERNMENT.

there is hope for getting out of this situation.
if it was a felony you have to try to pay to drop it to a misdemeanor.
if it is a misdemeanor you have to try to pay to have it expunged.
if it is expunged you have to try to pay to have it sealed.
then, you can try to pay to have the arrest records destroyed, at that point they say they delete something (which i find hard to believe)
if you go through these steps the courts will finally remember what is a crime and what is not.
if your felony was awarded for stealing a piece of pizza, you have a chance,
if it was child molestation, you don't.
local laws apply.

Are you saying a employer does not have the right to cover their a$$ in case someone sues them for the actions of a future employee?
I had to be checked out and fingerprinted before I was given a NATO security rating, did I like it? No but it came with the job. You might say the two are not equal but basically both are about covering their a$$. The world we live in now.

the American legal system is handing out crimes for everything, you get caught drinking a beer it's the end of the world.
none of these things protect companies from lawyers, the larger the legal system gets the more companies set aside money for lawsuits.
...guilt has nothing to do with anything

I suppose if your arrest record is long enough, you'll be approached to run for political office. Kind of a Serpico thing.....they need to feel secure that everyone involved is on the take."Excellence is the gradual result of always striving to do better"
