My HVAC contractor got a red flag on the permit that says:
"Wrong size breaker:
AHU Maximum Overcurrent Protection is 35 Amp, breaker is 50 Amp. Condenser MOCP is 40 Amp, breaker is 50 Amp"
Do you think it was just an oversight or was it deliberate with the intent of saving money on the part of the installer?

Here in MI, this would not fall under a mechanical contractors permit, but rather an electrical permit pulled by a licensed electrician.
Is the wire sized for 50a and is there a fused disconnect?
bingo...........good observation........I think that would be allowed.
As far as deliberately using the wrong size breaker to cut corners and save money, he paid more for the 50's than the 35 and 40 amp breakers.

He probably took out a larger less efficient unit and when he replaced it with a newer high efficiency unit forgot to change it.
The difference in price is equivalent to a cup of coffee at your convenience store. If he pinches pennies that much, you have bigger problems.
I like DIY'ers. They pay better to fix.
