I don't see a chimney in these pics. I do see what appears to be an unlisted vent terminating about 10" above the roof deck. Inadequate height above roof. Combustible roofing material at zero clearance. Probably not an approved roof penetration. Should have a chase to provide roof penetration. If this is backdrafting, tag out, lock out then send certified letters return receipt to customer, fire marshal and AHJ.
