The law is not at all muddled in my mind, geer.
If one fails a NICS check, it is my opinion that person should be investigated.
WHY were they denied? Was it a legitimate denial?
Most importantly, IF it was a legitimate denial, then that person's motives for attempting to purchase a firearm need to be investigated.
Certainly a better expenditure of finances than wasting money pursuing a gun buy-back program that will result in dead federal agents.

maybe, just maybe, there are a couple thousand people named JOHN SMITH, and a few of these John Smiths maybe felons. Now if your name was John Smith and you wanted to purchase a firearm but your named popped up on the NICS list, wouldn't you want a process in place that allowed you to clear your name. so you could buy that prized skeet gun
I know, this kind of logic is giving you a head ache, take a couple aspirin and go lay down you'll be fine, eventually

Why did that kid fail the NICS background check? What type of gun was he attempting to buy? Was it simply his age? They cant check medical records can they?
Investigating, suspecting and possible prosecuting for a motive for buying a gun would be very difficult. And dont bad guys just buy their guns from gun shows where there is no background check?

note an application that is denied does not trigger any type of alert to local law enforcement. Also, three primary databases do not cross-pollinate so there is room for slip-ups. On the mental disqualification, note it must be someone adjudicated to be committed to a mental institution. Your basic person having *issues* even under a doctor's care and receiving psych Rx is not automatically denied. Only 30 states use this system in full.Keep the fire inside the fireplace.

Brian, you obviously do not go to gun shows...
The 'sellers' at gun shows are generally old fashioned responsible folks, most who will talk your ears off about their military experiences if you let them. I have on numerous occasions asked them if they are cautious as to who they sell guns to... they say YES. Actually I observed a gentleman refuse to sell a gun to a shady looking guy... When the guy fussed about it... he was escorted (by a couple of ex-marines in plain clothes) to the police at the door... they arrested him for disturbing the peace.
So you can loose this idea that gun shows are a place to acquire a weapon... That is nothing more than another media myth. What worries me more is the way folks believe these media myths without even using any common sense... Does anyone ever wonder if they are being lied to? Or do they even care?
Where criminals get guns is on the street... as in back alley sales for cash. Usually the gun was stolen within the last 24 hours. Just ask a cop... that is, if you have a friendship with one. Generally they will not tell someone the truth unless they trust you.GA-HVAC-Tech

The exact opposite. There IS a way to tell one person from another, thats why there IS an appeal's process. If you get denied a firearm because the NICS, because your name is similar to a felon or anyone adjudicated Mentally deficient, then you can appeal and tell the BATF "hey, my name showed up on your list, here is my pertinent information (full name, SS# address...ect), please do an investigation so I can clear my name and purchase a new Trap Gun"
The BATF can do an investigation and send you form that will get YOU removed form the NICS list..No law ever prevented a crime.

No I do not go to gun shows but when you avoid saying whether gun shows do background checks or have a waiting period I can assume the answer is, no they do not.
And where do they steal the guns from. I’ll tell you, residences that do lock their guns in safes because they cannot afford to be delayed three seconds during that imaginary chance you’ll need a gun in your home.

no, not your normal family doctor type information. But anyone (in NYS) that was/is committed to a mental institution (even voluntary admission) is automatically listed with the state as Mentally deficient.
This is a huge contention with Psychologists. Many people with depression or other mental disorders will not seek treatment because the state will take their rights away, permanently. if you own $10,000 worth of firearms, you lose them forever. Even after treatment and a doctor says your fine.
This is why society must stop looking at mental disorder as a bad thing. Yes, schizophrenics and the like should NEVER get there hands on a firearm..No law ever prevented a crime.
