Yeah the leftest Democrats in the Senate along with a few turn coats kept Bush from appointing some Americans to the bench. Had to be a least moderate socialists before they would approve. So I won't even blame Bush for that other than he should have vetoed all the spending bills he let pass. Bush was to liberal for me but better than Gore or Kerry that is for sure. We need a Constitutional Amendment instituting term limits for the SCOTUS. You're not going to get an impeachment because of the nature of their jobs is "opinions" so what solid evidence could there be of 'felonies and misdemeanors' worthy our ousting one? No, set up a rotation so the damage they can do is limited.
The only mechanism to overturn bad SCOTUS rulings is by more Congressional laws. The SCOTUS just handed a lot of power back to the Congress yesterday so we should use it--if they make a bad ruling, re-write the law but frame it within the Constitution and according to the precedent they set yesterday, they would not have the right to overturn it.
Im not a fan of Chief Judge Roberts but if you want to look on the bright side roberts defined the penalty as a tax.
The implications of that are huge with the restrictions set on tax legislation. Article 1 sect 7
The commerce clause failed. They CANT make you participate in commerce so they can regulate it and govt has ALWAYS had the power to tax.
If anything it reigns in the federal govt and strictly limits their authority. From now on if they want to impose some massive fee it can only be defined as a tax.
Political parties that impose new taxs dont last long. Liberals are too stupid to realize the consequence of yesterdays decision.
It also basically handed the election to Romney. Obams lied. He raised taxes. There is no way he can argue against that now. 60% of America is against it.
Since its defined as a tax this fight isnt over and the liberals have been limited by yesterdays decision that defines the power of our govt.
Sure we wanted Roberts to rule against it but in a way hes thinking long term. There is no way that disaster of a law is going to be implemented in full. We cant afford it.
Hell since its a tax half the American people dont even pay federal tax. Also NO Democrat wants to talk about OBAMACARE.
OBAMA doesnt want to talk about the health care law but now it cant be avoided. We're pissed.
So look for a route in the Senate and Obama to be gone.
Also Holder was held in contempt. Our nations highest law inforcement official is a criminal.
So cheer up. Roberts didnt over reach he shot down the commerce argument and even got liberal judges to go along with him and just reaffirmed that yes our govt is allowed to tax its citizens.
Let the Democrats bring on the new taxs and lets watch them dissappear entirely.
I'm stretching it here but there may be some brilliance in this man's decision. After all, what better way to anger the people then a vote such as he made.

The new President has a chance of calling this obama plan finished once and for all. The Supreme Court would have only modified some and left most in place.

Where Roberts moved a legal line is the Supreme Court is suppose to interpet a law as unconstitutional or constitutional based on what is present to them and in the language and form presented. They can not change or write the law.
He decided to state that the health law was not fit under a commerce power of the Federal Government but it is under the Power of the Federal Government to tax it's citizens for running of the Government for the tax payers benefit.
He changed the intent and definition of what was presented to the Supreme Court. The Supreme Court is not suppose to do that. This opens the door for the Supreme Court to position the Federal Government to make decisions for us that fit what they want and not what is necessarily good for the citizens.

Congress has always had that power. Roberts didnt screw the American people, the Democrats did. Pelosi and Reid and Obama.
In his briefs he stated that Congress can not create commerce to regulate it.
But when the Dems have all 3 houses of Congress for two years of course there are going to be massive taces and tereible laws passed.
They're enjoying their marginal victory but will regret when Obama gets voted out and the Senate switches over to the Repubs.

The Supreme Court was not presented with this case as a tax. Even obama and his crew have denied it as a tax for years.
Roberts made the interpertation as a tax program himself which can be interpeted as constitutional.
Problem is, who you gonna complain to if the top court does wrong.
It's all up to us people to put in place a President that does represent us to the best of his/her ability and to follow the Constitution. And with that in place the President can eliminate this monster and put in place something realistic.
since it was defined as a tax it becomes a budget issue which can be easily done away with the same way it was passed with a reconciliation bill which only requires 51 votes in the senate to pass
