It's all about the schools. In some places (most that have these booms in 55+ housing), there is land to build houses but no additional school capacity in that area. So local zoning and housing regulations would prevent the building of next houses there. If you have a 55+ community, however, the idea is that such people should not have K-12 aged schoolchildren so it's OK to build these without overtaxing the schools.

A little known, well guarded secret is that they CANNOT prevent you from living/buying in a 55+ community if you are underage-provided they haven't met their required percentage of underagers already[4% maybe-not sure]. They will adamantly claim that you cannot live/buy there-no exceptions, but the threat of legal action is usually all it takes because they know they'll lose and then they are liable for punitive as well. This is right there with the Parkway putting up a sign on the toll booths saying "NO PENNIES". Well some guy sued and sure enough pennies are legal currency and they are required to accept them-so now the sign says "NO PENNIES PLEASE". And how many times have you seen signs in stores that say "No Credit Card Charges Under $10"? [or$15orwhatever]. Well, fact is the merchant signs an agreement with Visa/Mastercard/Amex that obligates them to accept CC charges no matter the amount! So next time some snooty wanker gets you twisted just put a 10 cent mint on your Visa, and when he says no, watch how fast he says OK when you start dialing the cust.service # on the back of your card!

I too have always wondered how they get away with it. It's nice and all but does seem to be discriminatory.
My older brother lives in Port St. Lucy. We went down for 2 weeks. I'm 61. They live in a private single family house. Even though I enjoyed Florida I couldn't put my finger on the strange feeling I had while there. When we got to the airport it dawned on me. There were no kids around in Florida. The Elks Lodge closed at 6 P.M. Everyone eats the early bird specials at 3:30. Drug store on every corner. And Cadillacs up the wazoo. Don't get me wrong I get along with old people but I wouldn't want to be isolated from the world. I don't get annoyed when I hear a baby cry. To me it is a sound of celebration.

Dropping the kids off In Fla, a place for a 55 y/o is a Day Care Center! They spec. 55 y.o because according to the Guv'ment, the kids should have moved away. They don't want noisy kids around. They are interest in peace and quiet. If you have a dog or cat most let you keep it inside but once it dies, you cannot replace it. Kids can visit but are limited to staying usually 2 weeks continuously up to a max. of 30 days per yr. As Cosby once told Theo, parents aren't interested in justice, they're interested in QUIET!!!!

I live in Florida, the capitol of the age 55 community. The 55 rule is legal, and to keep it like that, not live in, but on the title, one of the owners must be 55 or older. And, must be 75% of the owners over 55. To have a 55 rule, and stop anyone from living...in a 55 age community, 85% of the owners that reside there must be 55 or older.

My Dad lived in on of those 55 or over townhouse projects 2 years ago, he is over 80 and people living there kept bugging him Ed can you fix this can you fix that finnaly after two years he got tired of the whinning old fogies as he called them and had another single family house built.
As some of you know, I do a LOT of RNC work, and I am always going to new developments. Currently, we have two "55 and older" developments that we are involved in. In the model is the association bylaws, which clearly state that someone 55 or older must live in the home or they won't sell it to you. How can they do that? That's discrimination based on age, is it not? How is this different from saying "No blacks allowed" or "No queers"? Federal Housing Laws prevent realtors from discrimination based on age, race, or preference, so how can a builder do this? PLUS, these 55 and older developments are chock full of old people who have nothing left to do in life except time the furnace and log it so they can call and say "It runs TOO MUCH!".
