18" on that roof wouldn't make much of a difference to the guys view, he was upset because of the house, he happened to find out it was 18" too tall.

If my neighbor encroached my side setback by 18" I wouldn't worry about it, if he encroached it by 25', I would have an issue with it, which is what the side setbacks are where I live, as a matter of fact I think he has two buildings that are within the 25' side setback.

Example, my Hood. Plenty of by laws to help prevent homes, landscaping and use that would unsightly, intrude on neighbors, and devalue adjacent properties. Basically that was the intent. It was set up long time ago and everyone looking to live or build there is made aware of it so don't come here if you don't like the by laws. Easy enough, not really that bad compared to other developments.
One of the bylaws were setbacks. When one home I had was built it was 16'.
New home built next to me was less than 8'. Before I could file papers, it was changed to 8' and this guy slid on by. His partner was a major real estate mover and shaker here. Also they backfilled the lot which we weren't allowed to do, had a hard time controlling drainage but finally got it to work, (years). 1st big storm washed 80% my landscaping away on that side of the yard because of the water flowing off their lot.
Another was exterior finish colors. Can't have house all the same colors. Same guy built 2 homes across the street same colors including trim, but because they were from different mfg's with different names for the same color he slid by. When the third house started putting up the siding I told them I now had more time and more money than before so they'd better reconsider the choice.
Finally moved when I got married, same hood, different section. Same builder started to build two houses by me, one to one side of me, one across the street. I met with him, we talked and both agreed that rules would be followed by him. Neither one of us wanted the hassles but I would if I had to, and fast.

Dispute Between Neighbors

A city councilman in Utah, Mark Easton, had a beautiful view of the east mountains, until a new neighbor purchased the lot below his house and built a new home.

The new home was 18 inches higher than the ordinances would allow, so Mark Easton, mad about his lost view, went to the city to make sure they enforced the lower roof line ordinance.

The new neighbor had to drop the roof line, at great expense.
Recently, Mark Easton called the city, and informed them that his new neighbor had installed some vents on the side of his home.

Mark didn't like the look of these vents and asked the city to investigate.
When they went to Mark's home to see what the vents looked like, this is what they found...




The City Council said the vents can stay since there is no ordinances referring to shutter design.
