Hi Everyone.
I am looking to get some expert opinions.
I live in a condominium complex. I am responsible for the HVAC unit on the roof, but the roof is the responsibility of the HOA. I just had to have a new HVAC unit put on the roof, which is spray foam. The person who applied the spray foam, just sprayed up to and onto the old HVAC unit. So when the new unit got put on, we had to cut the spray foam, have a roofer spray the roof where the unit was and then put the new unit on.
The problem is that I am trying to get my HOA to pay for the roof repair since I feel the work was not done properly to begin with. The unit should have been removed to spray the roof and then put back in place. The HOA is saying I am responsible for repairs and has refused to pay for it. I am contemplating taking the HOA to small claims court to get reimbursed for the roof repair, but I need something to back up my theory to the judge.
