Deadly force statutes in Texas allow for situations like this. If his neighbor asked him to watch over his home ,it's permissible.What would you have done ? Help these crooks load their STOLEN booty in the trunk and wished them a good day? I think not. Not living here you look at this in a different light. The saddest thing is ,there's a hundred more of these low lifes to take the place of these bums. What should he have done in your opinion? According to the DA he did absolutely nothing wrong,and I agree.

We just had a guy that tried to steal a a guys car and the guy chased him for a 1/4 mile and shot him dead.
There was a big outrage not because the punishment for stealing was death but because the guy that shot him 1/4 mile away was a Jar Head.
I know a whole bunch of Vets and a whole bunch of Jar Heads but that is the only reason all of the "Citizens" wanted to give him a pass is for his service.
The stealer guy was an addict as are a whole lot of Vets I know. Not much difference here.
No one should be killed for something like stealing. Unfortunately some Vets steal for reasons many of you can only imagine.
Tolerance is probably beyond some here as they would kill you for a clock radio but this isn't for them as I feel they are beyond salvation for now.
Don't be self richeous as how you think it's your moral right to kill. It could be you. Oh ya... the stealer guy had kids that don't have a father.
And I'm not a whiney liberal... Just a relist.

I do, so far this year, I have just over 1200 rounds through my Glock, thats about 30 times the number of rounds cops shoot (thats practice and competition ) and we're only half way through the year :eek:;)

I am piss tired of those who are supposed to be protecting us constantly telling us not to protect ourselves or our property while all the time whining that they themselves cannot protect us! All the police are trying to do is to protect their jobs.

And by law he was justified.....back or not. He stopped them in the commission of a crime....he stopped them before they could get away with the stolen items. The law states that he was justified.

The 911 tape should be listened to the end. After the shooting he said the criminals came into HIS yard. That means HE felt threatened and he said that they came into his yard, he had no choice. Good for him and for Texas!

Very well stated, I hear all the time, that property is not worth taking a life. Look at it this way, we ALL must live with the consequences of our decisions. These criminals decided to rob someone and in most places, that means the possibility of facing an armed citizen to do so. The criminal decides the property is worth his life when he/she makes the decision to take from someone else.

There are a thousand and one “what ifs” we could get into in a case like this but I think he should have listened to the 911 dispatcher and stayed in his house. My gut instinct is to cheer for this guy, but after reading the story, it appears to me that he shouldn’t have gone about it the way he did. He went too far by confronting these crooks. If they had confronted him it would be completely different. He did not know that they were unarmed. It was two against one and if they had been carrying guns, he likely would not still be with us.
As far as a lawsuit by the crooks family, I personally believe that if you are not legally in this country you do NOT have ANY rights under our Constitution.

But I can only tell what happened from the recording the guy made and the news report.
From my stance, he shot them because he wanted to.
Is some other states, that is a capital offense. Especially the lying in wait part... If he was not in Texas, he would be in Jail. Probably conferring with his attorney on how to appeal his death penalty case.

On this we agree. If Mr Horn had shot those criminals in the state of New York Mr horn would have been arrested for murder.
The deceased relatives would have a wrongful death suite and Mr Horn would have lost everything, including his home and anything else he owned.
UNLESS!! Mr Horn could produce overwhelming evidence that his life was in danger.
what Mr Horn should have done was tell the dispatcher that he was going out to hold them for the police, then if he had to shoot, he would have a better reason to shoot

Maybe I should have posted a link but it might not have changed your mind.
The Marine ( and I have serious respect for those I consider my brothers) surprised the thief, the guy ran. So his property was no longer in danger. But the Marine chased the guy on foot for what was said 1/4 mile and shot the guy. The Marine was in no personal danger. His property was safe. But he decided to run the guy down and shoot him.
Every one was sad at the trial and at the decision to release the Marine after time served ( two months) even the mother of the dead guy understood the judge.
Personally I don't think given the facts in this case it was about property. I think it was more like " How dare you f**k with me.
I hear a lot of people on this thread boast about how brave they are and what they would do if anyone dared to mess with them.
I believe some of them. Others I don't. I'm don't know any of you but I know as a Vet, solders don't chose to use bragging rights much. Solders are a rather humble crew when it comes to combat. Luck is king.
Some might go over in their mind this fantasy or that but it will only be in the actual situation where the truth will be found.
This is not a video game.
I think Texas in this situation about property is living in the 1800's
But if some here don't think about what can happen to change one's live then I don't know where your redemption will come from.

Now this I can argue with. Some of those laws were passed only just last year. I think we as Texas citizens voted for them. So,we must be in the majority.If the people don't like the laws,then they vote against them and change them. But for now Joe hasn't broken any laws.

Not only are we inundated wife illegal’s that are criminals but also still have huge numbers that came in from New Orleans.
We had a police officer shot last year by an illegal that had been deported and then come back. He was brought back by his boss so he could work for his landscape business. We had a young mother that was stabbed to death outside a phone store by two illegal’s. Our police force and Sheriffs departments are under staffed and hampered by local and state governments that think we should be a sanctuary and not prosecute or offend these people.
By all means I am not saying that all illegal’s or LA. folk were criminals but a vast percentage were/are.

True stories about two of my customers and one about my wife.
Had a customer driving down the road in his classic Jag. Two wetbacks slam into his car at an intersection in an old Olds 98. He has to be cut out of his car almost dies and is crippled and in pain for the rest of his life. He was in his mid 40's. The two punks are unhurt and run off eventually caught and they have no insurance or license and disappear before the trial.
Next is an older woman in her early 60's, she and her sister are driving along in their Suburban. Two illegal Mexicans broadside them, the sister is killed and the other is hospitalized for months and cannot work for almost a year more. They Mexicans are caught they have no insurance, license and disappear before a trial. Her insurance only pays a small percentage of her cost and ruins her financially.
My wife is sitting in an inside lane of four lane road with her blinker on. Illegal Mexican driving a car that is not his runs in to her never hits his brakes. She calls me I show up before the cops can along with about five wreakers. The clown that hit her wants to use her cell phone. He acts like he cannot speak English.
I arrive this guy starts running his mouth, wrong attitude with me. He tries to leave I grab him and hold him. Cop finally shows up and gives him a ticket, but cannot ask him if he has insurance even though it is state law. Had this guy been white black or a legal Hispanic he would have gone to jail. Since he obviously illegal the cop says he cannot ask or take him to jail. I ask why, because we (HOUSTON) are a sanctuary city. He did tell me if I didn't calm down I was going to jail. All he could do was not let the guy drive off in his wrecked car. Guess what the guy didn't show up in court for the ticket and my insurance company could not locate him because the identification he had was for someone that did not exist.
